Triple Talaq Case: Supreme Court given historical judgment




The Supreme Court of India given its miserable instructions today on Triple Talaq and asked Parliament to make a law on Triple Talaq within the next six months.  The 5 Judge bench of the Supreme Court opined that “the term Triple Talaq as void, illegal and unconstitutional”, also said that the Triple Talaq is unconstitutional and violation of Article 14 and 15 of Indian Constitutional Law and also said that Trible Talaq is not intrinsic to Quran.A.

Justice Kurian Joseph told his view that, the practice on the ground that it goes against shariat and the basic tenets of the Quran.  Cief Justice J.S. Khehar and Justice Abdul Nazeer opposed this.

While telling the judgment, however, support the practice and said, “Talaq-e-biddat is not violative of Articles 14, 15, 21 and 25 of Indian Constitution”.

The Supreme Court also asked all the political parties to maintain their differences away and cooperate the Central Government to carrying out a law on instant triple talaq and also opined that trust the Centre would acquire into version concerns of Muslim bodies and Sharia law while ratify a law.
